This Article is published for the benefit of foreign Nationals staying in India on a residential permit or visa. Any foreign national who is in India on a valid visa and requiring an extension, should submit an application to extend the residential permit / visa at least 60 days prior to the date of expiration of current status.

Timely filing of an application to extend one’s stay is important. Overstay attracts prosecution under Foreigners Act 1946, which includes imprisonment of up to five years along with fine and expulsion from India. Under certain special circumstances, the delay in filing for renewal of Residential Permit may be condoned at the discretion of the office. In such instances a penalty of US$ 30 will be payable in the Indian Rupee equivalent.

A detailed list of documentation required in support of an application to extend one’s stay can be found on the official website of the Bureau of Indian Immigration. It is important to note that this list varies based on the visa category.  This application can be made online, using the e-FRRO application form.
