On December 21, 2023, the U.S. Secretary of State in consultation with the Department of Homeland Security (DHS) announced that specific categories of interview waivers are deemed to be in national interest. This will be effective January 1, 2024, onwards and will undergo annual review.
Waiver of In-person Interviews
Consular officers now possess the authority and discretion to waive in-person interviews for the following:
- First-time H-2 visa applicants (temporary agricultural and non-agricultural workers); and
- Other nonimmigrant visa applicants applying for any nonimmigrant visa classification who meet the following criteria:
- Were previously issued a nonimmigrant visa in any classification, except for a B visa.
- Are applying within 48 months of their most recent nonimmigrant visa’s expiration date.
It is important to note that applicants renewing a nonimmigrant visa in the same classification within 48 months of the prior visa’s expiration date are still eligible for interview waiver until further notice.
Eligibility to Qualify for Interview Waiver
To qualify for an interview waiver, applicants must meet certain criteria, including:
- Applying in their country of nationality or residence.
- Never having been refused a visa (unless such refusal was overcome or waived).
- Having no apparent or potential ineligibility.
