Increase in INA 221(g) Queries for H1B and Longer Processing Times for Administrative Cases

Many first time H1B beneficiaries will be gearing up for their consular H1B visa application process as the start date for H1B employment (October 1) approaches. It may be recalled that one can apply 90 days prior to the start date mentioned on the I-797 and can travel up to 10 calendar days prior to the start date listed on the I-797.

We at Murthy Immigration Services have noticed that there is an increase in the number of INA 221(g) cases over the past few months. We have noticed that this pattern is higher for consulting companies and positions involving employment at third party sites. Administrative processing times for such cases are significantly longer.
Applicants / employers should be aware of this situation and obtain all necessary supporting documents from the client / vendor in order to present all facts clearly and unambiguously at the visa interview. This can avoid extended processing times, which increases the burden on the consular offices.
