With H1B filing season around the corner, U.S. consular posts in India advise the public to beware of fraudulent job offers. We, at Murthy Immigration Services Pvt. Ltd., receive numerous calls from persons who have received emails from companies that claim to be H1B sponsors, but in fact are not. The targets of this scam are typically asked to attend telephone interviews, and after they “qualify” for the position offered, they are asked to pay huge sums of money for “further processing” of their work permits (petitions) or visas. They are often informed that a visa will be “arranged” without an interview. Those who are well informed about U.S. immigration law will immediately recognize this request as a warning sign: under U.S. Department of Labor regulations in this regard , all H1B-related USCIS filing fees are to be borne only by the petitioning company. Further, first time H1-B applicants need to appear for a personal visa interview.
